Terms of Service

These terms apply to your use of mindevolved.com (the "Site"), which is operated by Mind Evolved Pty Ltd (ABN 76 620 250 295, ACN 620 250 295) ("MINDEVOLVED", "we", "us", "our"), of Tower Three - Level 24, 300 Barangaroo Avenue, Barangaroo NSW 2000. By accessing or using the Site you agree to these terms. If you do not agree, please do not use the Site.

The Site and our services

The Site provides general information about MINDEVOLVED and its services. These terms cover your use of the Site only. Any work we do for a client is governed by a separate written agreement, which prevails over these terms if they conflict.

No advice and no engagement

Content on the Site, including blog posts, guides and case studies, is general information only. It is not legal, financial, technical, regulatory or other professional advice, and you should not rely on it as such. Contacting us, submitting the contact form or booking a consultation does not create a client relationship or commit either of us to any engagement.

Case studies describe past work for particular clients in particular circumstances. Results vary, and past results do not guarantee future outcomes. Third-party names, logos and trade marks belong to their owners and appear only to identify the work described.

Acceptable use

You must not: interfere with or disrupt the Site or its security; probe, scan or test its vulnerabilities without our written permission; attempt to gain unauthorised access; use automated tools to scrape or bulk-copy the Site or its content (including to train machine learning models) without our written permission; submit false, misleading or unlawful content; or use the Site in breach of any law.

Information you submit

You promise that the information you give us through the Site is accurate and that you are entitled to share it. You give us permission to use it to respond to you and to operate our business, as described in our Privacy Policy. Please do not submit confidential or sensitive information through the Site; we cannot treat it as confidential unless we have agreed to do so in writing.

Intellectual property

The Site and its content, including text, graphics, logos, design and code, are owned by Mind Evolved Pty Ltd or its licensors and are protected by copyright and other laws. You may view the Site and share links to it. You may not copy, modify, distribute, or commercially use our content without our written permission, except as the law permits (for example, fair dealing).

Third-party sites and services

The Site links to and embeds third-party services (for example LinkedIn, GitHub and cal.com). We do not control them and are not responsible for their content, availability or privacy practices. Your use of them is subject to their own terms.

Disclaimers

We try to keep the Site accurate and available, but we do not warrant that it is complete, current, error-free, uninterrupted or free of harmful components. To the extent the law allows, the Site and its content are provided "as is".

Consumer law

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or term, that the Australian Consumer Law or any other law says cannot be excluded, restricted or modified. Where our liability for a breach of such a guarantee can lawfully be limited, we limit it, at our option, to resupplying the services or paying the cost of having them resupplied.

Limitation of liability

Subject to the Consumer law section above and to the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, revenue, data or goodwill, or business interruption, arising from your use of, or inability to use, the Site or from reliance on its content.

Indemnity

You indemnify us against loss or damage we suffer as a result of your breach of these terms or your unlawful use of the Site, except to the extent we caused or contributed to it.

Privacy and cookies

Our Privacy Policy and Cookie Policy explain how we handle personal information and what cookies the Site uses. They form part of how you may use the Site.

Changes

We may change the Site and these terms at any time. The "Last updated" date at the top of this page shows when these terms were last revised. If you keep using the Site after a change, you accept the updated terms.

General

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales. If any part of these terms is unenforceable, the rest remains in force. These terms are the entire agreement between you and us about your use of the Site.
